EICR Requirements for Landlords
In the UK, it is a legal requirement for landlords to have an EICR carried out on their rental properties. The key requirements include:
- Frequency of Inspections:
- The Electrical Safety Standards in the Private Rented Sector (England) Regulations 2020 require that an EICR is conducted at least every 5 years for any rented property.
- For newly built or newly rented properties, an EICR must be done before the first tenancy begins.
- Qualified Electricians:
- EICRs must be conducted by a qualified electrician who is registered with a government-approved scheme, such as NICEIC or NAPIT.
- Tenant Safety:
- The EICR checks the condition of electrical installations, such as wiring, plugs, sockets, and consumer units, to ensure they are safe for tenants and meet the required safety standards.
- Reporting:
- Once the EICR is completed, the landlord is required to provide a copy of the report to the tenant within 28 days of the inspection.
- If the report identifies any hazards or safety issues, landlords must take corrective action. This includes any “C1” or “C2” codes that indicate serious risks, and work must be carried out to remedy these within 28 days.
These Regulations apply in England to:
- all new specified tenancies from 1st July 2020
- all existing specified tenancies from 1st April 2021
Enforcement
Local Authorities will be responsible for enforcing the new regulations and can impose a financial penalty of up to £30,000 if they find a landlord is in breach of their duty.
Local Authorities have the power to serve remedial notices on the private landlord. If the remedial notice is ignored by the private landlord and action is not taken with 28 days, the Local Authority can arrange remedial work to be carried out, with consent from the tenant, and recover the costs from the landlord.
